Особенности взимания платы за посещение особо охраняемых природных территорий в Республике Крым

Аннотация. Рассматриваются правовые аспекты платного посещения особо охраняемых природных территорий. Особое внимание уделяется сравнению федерального и регионального законодательства. Представлена информация о правовом положении и структуре бюджета ООПТ. Результат работы – предложенный комплекс мер, необходимый для решения рассматриваемых проблем. Содержатся рекомендации по управленческой и бюджетной политике в отношении земель ООПТ.

Summary. At the present time issues of land legislation are particularly important on the territory of the Republic of Crimea. Almost four years have passed since Crimea's reunification to Russia, but these issues are still not fully adjusted. The situation with specially protected natural areas is particularly acute. Crimea is a resort region, nature reserves form the basis of biosphere and natural diversity. However, land plots are registered in private ownership, paid visits to such places are introduced. This is largely due to the fact that these lands are not put on the cadastral register, which by the letter of the law is not a violation. In the article the budget sphere of protected areas is analyzed, the causes of this situation are considered. The main task is to suggest possible solutions of the crisis, first of all, using the methods of maintaining the state cadastre. This article is written using the materials of judicial practice, as well as explanations of the Prosecutor General of the Republic of Crimea. For a complete description of the problem it is compared with analogues in the rest of the Russian Federation. The General structure of protected area lands is obtained from the information of the Ministry of ecology and natural resources of the Republic of Crimea, public cadastral information is also used. For this reason, recommendations to remedy the situation applying the management measures and emphasizing fiscal policy have been given. There are also proposals for the legalization of income. The result of the work is a step-by-step set of measures that will bring the protected areas into compliance with their legal status.
