Направления развития кадастрово-регистрационных систем в свете лучших мировых практик: пример подземных объектов недвижимости

Аннотация. Растущая сложность инфраструктуры и плотно застроенных территорий требует точного оформления юридического статуса объектов недвижимости, который лишь в ограниченной степени обеспечивают существующие 2D-кадастровые системы. Решению этих задач способствует создание 3D-кадастра. Рассмотрены мировые тенденции в развитии кадастровых систем. Проанализированы особенности кадастрового учета и регистрации прав на объекты недвижимости, преимущественно находящиеся под землей. Особое внимание уделено мировому опыту регистрации коммуникаций. Выявлены основные проблемы российского законодательства при описании и учете трехмерных объектов недвижимости и предложены пути их решения.

Summary. Under the formation and development of market relations, both in Russia and over the world, issues of regulation of land relations acquire higher importance. The Earth has become not only the means of production and a source of material benefits, but also an object of legal relations and turnover of immovable property. Due to this circumstance, new priorities in the management of land resources have been defined. They are: increase in budget revenues via clarifying the taxable base, encouragement of investment to the real estate market, development of an effective system for the protection of rights of real estate holders. The increasing complexity of infrastructures and densely built-up areas requires proper procedures of registration of the real estate legal status to be developed. Unfortunately the existing 2D-cadastral registration systems support them in a limited extent. The cadastral map is to show full and comprehensive spatial information on registered rights on the real estate objects, restrictions and responsibilities. The creation of 3D-cadastre might solve these problems. Over the past decade various studies related to 3D-cadastres have been conducted over the world. World trends in the development of cadastral systems are considered in this article. The features of cadastral registration and registration of rights to real estate objects, mainly located under the Earth’s surface, are analyzed. The world experience of registering the utility systems is emphasized. The main problems of the Russian legislation concerning description and registration of three-dimensional real estate objects are revealed. Solutions are offered.
